Terms of Use

1. Acknowledgement & Acceptance

These Terms of Use ("Terms") constitute a legal agreement between you ("User") and Muse ("Developer," "we," or "us") regarding your use of the Muse mobile application ("App").

By downloading, installing, or using the App, you acknowledge and agree that:

  • These Terms are concluded between you and the Developer only, and not with Apple, Inc. ("Apple").
  • The Developer, not Apple, is solely responsible for the App and the content thereof.
  • You agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Muse is a movie recommendation utility that presents curated film suggestions through an interactive interface. The App allows you to:

  • Select movie preferences (genre, era, origin, duration).
  • Receive personalized movie recommendations via a cinematic spin interaction.
  • Maintain a local or cloud-synced archive of your movie picks.
  • Sign in with Apple to synchronize data across devices via Google Firebase.

3. User Accounts & Data

3.1. Anonymous Usage

You may use the App without creating an account. In this case, your data is stored locally on your device or associated with an anonymous identifier. Anonymous data cannot be recovered if the App is deleted or the device is lost.

3.2. Apple Sign-In

You may choose to sign in using your Apple ID. By doing so, you authorize us to link your data to a unique user ID provided by Apple's authentication service. This allows for data synchronization across devices.

3.3. Account Security

You are responsible for maintaining the confidentiality of your device access and account. You accept responsibility for all activities that occur under your account.

4. Purchases and Payments

4.1. Free Tier

The App offers limited free usage, which may include a set number of daily interactions or restricted access to specific filters. We reserve the right to modify the limitations of the free tier at any time.

4.2. Muse Premium (Lifetime Access)

Muse Premium is a "Non-Consumable" In-App Purchase that permanently unlocks premium features and removes daily limits.

  • One-Time Payment: This is a single, lifetime payment. It is not a subscription and does not recur.
  • Payment Processing: Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Family Sharing: If enabled by us and supported by Apple, this purchase may be shareable with your family group.

4.3. Refunds

All purchases are processed directly by Apple. We do not have the ability to process refunds. Refund requests must be submitted directly to Apple Support in accordance with their refund policies.

5. Intellectual Property & Third-Party Data

5.1. App Ownership

The Muse App, including its source code, design, interface, branding, and original content, is the exclusive property of the Developer and is protected by copyright and intellectual property laws.

5.2. TMDB Attribution

This product uses the TMDB API but is not endorsed or certified by TMDB.

Movie metadata (including but not limited to titles, posters, overviews, and ratings) is provided by The Movie Database (TMDB). All such data remains the property of TMDB and its respective content owners.

5.3. User Content

Any content generated by you within the App (e.g., watch lists, history) remains your property. You grant us a limited, non-exclusive license to store and process this data solely for the purpose of providing the App's functionality.

6. Acceptable Use Policy

You agree not to:

  • Use the App for any unlawful purpose or to violate any applicable laws.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Use automated systems (bots, spiders, scrapers) to access the App or extract data.
  • Interfere with the proper working of the App or its backend services (Firebase/RevenueCat).

7. Disclaimers and Warranty (Apple Required)

7.1. "As Is" Basis

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, we expressly disclaim all warranties, whether express or implied, including warranties of merchantability and fitness for a particular purpose.

7.2. Maintenance and Support

You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. Any support inquiries should be directed to the Developer, not Apple.

7.3. No Guarantee of Recommendations

Movie recommendations are generated algorithmically. We do not guarantee the accuracy, availability, or suitability of any recommended content. Availability of movies on streaming platforms is subject to third-party rights and is beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any incidental, special, indirect, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the App.

In no event shall the Developer's total liability to you for all damages exceed the amount of fifty dollars ($50.00) or the amount you paid for the App, whichever is higher.

9. Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

10. Termination and Account Deletion

10.1. Account Deletion

You have the right to delete your account and all associated data at any time directly within the App via the Settings/Profile menu. This action is irreversible and permanently removes your data from our Firebase servers.

10.2. Termination by Developer

We reserve the right to suspend or terminate your access to the App immediately, without prior notice, if you breach these Terms.

11. Governing Law and Dispute Resolution

11.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, excluding its conflicts of law rules.

11.2. International Consumer Rights

If you are a consumer based in the European Union, the United Kingdom, or the United States, you may benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms, including the choice of law clause above, affects your rights as a consumer to rely on such mandatory provisions of local law.

11.3. Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts and enforcement offices in Istanbul, Turkey. However, if you are a consumer in the EU, you may bring a claim in the courts of the country where you reside.

12. Changes to Terms

We reserve the right to update these Terms at any time. If changes are significant, we may notify you through the App. Continued use of the App after changes constitutes acceptance of the new Terms.
